Welcome to Am I Paid?. We created this service to make it easy for you to see if you have been paid money you are expecting. These Terms of Use set forth here constitute a legally binding agreement between 3rd Square Software Limited ("3rd Square", “Am I Paid” “amipaid” “amipaid.com”, “amipaid.co.uk”, "we", "us" or "our") of registered office is 2 South View Terrace, Plymouth, England, PL4 9DQ ("3rd Square") and the individual(s), application, service, or business named on the registration page ("you", "your", "user", or "client"). By registering with us on our website ("Site"), or by using our service in any way - you agree to these Terms of Use and all other operating rules, policies and procedures that will be published from time to time on the Site. The Site and the Am I Paid service will be referred to together as the "Service".

The Services

The Service enables users to connect Am I Paid with end-user-authorized data from financial institutions including banks, card issuers, and card networks ("banks"). The Service constitutes a website which you (the "User") may use to setup alerts to be notified if expected payments do not get paid into your bank. The Service is not offered by or affiliated with any of the available banks. The Service allows the User to execute swift and secure bank checking in a user-friendly interface that would otherwise be laborious. We are neither a bank, money service business, nor payment processor – and we do assume any liability for the transactions being tracked through this service.

We use Plaid Technologies, Inc. (“Plaid”) to gather End User’s data from financial institutions. By using our service, you grant us and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy, available at https://plaid.com/legal.

Terms and Conditions

  1. INTRODUCTION

    1. Please read the Terms and Conditions carefully before you begin using the Service. If you do not accept these Terms and Conditions, do not use the Service or proceed with the intended transaction(s). By using the Service, you agree to the Terms and Conditions as set forth in this Agreement at the time of the transaction. The Terms and Conditions may be revised from time to time without prior notice and the User must therefore ensure that the terms are reviewed in each case before proceeding with a transaction. In the event of a change of the terms, the revised Last Updated date will be published.

    2. We may change the Service:

      • to reflect changes in relevant laws and regulatory requirements such as our requirements and obligations; or

      • to implement minor technical adjustments and improvements, for example to address a security threat.

  2. LOGIN INFORMATION ETC. PROVIDED BY THE USER

    1. 3rd Square do not capture or store any banking security credentials (codes/passwords etc.), this is managed by our third party. The login information provided by you during the transaction process is authenticated directly by Plaid and the Banking Providers. The service forwards the information, through the Service interface, to the corresponding interface of your chosen bank via your computer.

    2. Your receiving money shall at all time be subject to your agreement between yourself and your payor and 3rd Square shall in no way be liable for the actions or inactions of your expected Payor.

  3. AUTHORIZATION / PERMISSION TO FORWARD INFORMATION ABOUT THE USER

    By using the Service, the User agrees that information about the User and the details of the transactions to be made (including amounts, names, telephone number, e-mail addresses) may be used by 3rd Square for the purpose of identifying the expected transaction.

    Once the User has entered all its required details into the various part of the online interface and clicked submit, the User will be deemed to have expressly requested and authorised the information to be monitored and retrieved.

  4. GENERAL REQUIREMENTS FOR ELIGIBILITY TO USE THE SERVICE

    1. In order to use the Service, Users must be at least sixteen (16) years of age, or of such age as required by Plaid or banks, with capacity to enter into legally binding contracts and must have the right to view banking data associated with the account(s) in use. The User hereby confirms that these requirements are met.

    2. The User confirms that it shall not use the Service for any purpose that is in violation of its agreements with third parties (including banks used in connection with the Service) or applicable law. The User is personally responsible for any and all such violations and acknowledges, by using the Service, that the use of the same does not result in any such violation.

  5. SUSPENSION OF THE SERVICE

    3rd Square may have to suspend the Service to deal with technical changes or to update the Service to reflect changes in relevant laws and regulatory requirements.

  6. LIABILITY AND COMPENSATION

    1. 3rd Square expressly disclaims any warranty for the Service. The Service and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Service remains with you. You agree to check to make sure that your use of this Software does not constitute a breach of any banks policies or terms and conditions, and misuse could result in your bank accounts being blocked or suspended.

    2. In no event shall 3rd Square be liable for any damages whatsoever (including, without limitation, damages for loss of business or personal profits, interruption, information, or any other pecuniary loss) arising out of the use of or inability to use the Service, even if 3rd Square has been advised of the possibility of such damages.

  7. POTENTIAL CHARGES AND FEES APPLIED BY THE BANK OF THE USER

    When monitoring for transactions through the Service banks may charge their usual fees according to their terms of the agreement. By using the Service, the User acknowledges that he or she is solely responsible for any and all fees applied by his or her bank.

  8. PRIVACY POLICY AND PROCESSING OF PERSONAL DATA

    The User, through its consent to these Terms and Conditions before use of the Service, consents to the Privacy Policy as documented throughout the Service.

  9. NOTIFICATIONS OF DELAYS, INTERRUPTIONS, MALFUNCTION ETC.

    Users must immediately notify 3rd Square of any errors or malfunctions in the Service that they become aware of. Upon notification by the User, 3rd Square will use its best efforts to remedy any malfunction without delay.

  10. FORCE MAJEURE

    Subject to clause 6 (Liability and Compensation) 3rd Square shall in no case be liable for any economic loss, delay or failure in performance to the extent such loss, delay or failure is caused by fire, flood, explosion, war, strike, embargo, governmental requirements, civil and military authority, data trespass, unlawful action of the User or any other cause beyond 3rd Square’s reasonable control.

  11. SEVERANCE

    If any provision of this Agreement is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this Agreement which shall remain in full force and effect. If any provision of this Agreement is so found to be invalid or unenforceable but would cease to be invalid or unenforceable if some part of the provision were deleted, the provision in question shall apply with such modification as may be necessary to make it valid and enforceable.

  12. GOVERNING LAW

    These General Terms and Conditions and the agreement it constitutes shall be governed by the laws of England and Wales. Disputes shall primarily be resolved by negotiations in good spirit between the parties following a claim being filed by the User after which 3rd Square shall consider the claim within thirty (30) days. If the parties are not able to reach an amicable agreement regarding the claim, the dispute shall be resolved in accordance with the rules of civil procedure. All communications with regard to these General Terms and Conditions shall be in English.
